Beta Testing Agreement
Signing up for the Beta Test Program on this website and receipt of PsychScan reports confirms your understanding of and agreement to the following:
Subject to the terms and conditions of this Agreement, Company grants Recipient a nonexclusive, nontransferable license to use the Company service (“Service”) for the purpose of testing and evaluating the Service.
Licensee’s rights with respect to the Service will terminate upon the earlier of (a) the initial commercial release by PsychScan of a generally available version of the Service or (b) automatic expiration of the Service after a period of six months. Either party may terminate this Agreement at any time for any reason or no reason by providing the other party advance written notice thereof.
In consideration for use of the Service, Recipient agrees to good faith disclosure to PsychScan of any issues using the Service, as well as providing feedback about the Service if requested.
The PsychScan report is for general informational purposes only. It is not intended to diagnose, treat, cure, or prevent any medical or mental health disease or condition and is in no way to be interpreted as providing medical or mental health advice. The information obtained from this should not be considered a substitute for a thorough medical and/or mental health evaluation by an appropriately credentialed and licensed healthcare professional.
PsychScan, LLC and its parents, subsidiaries and affiliate organizations, and all of their respective attorneys, agents, employees, representatives, administrators, officials, members, shareholders, officers, managers, directors, successors, assigns, and personal representatives (collectively, PsychScan, LLC), are not liable or responsible for any advice, course of treatment, diagnosis, or any other information, services or product you obtain through this site. Reliance on a PsychScan report is solely at your own risk. PsychScan, LLC, are not and shall not be liable for any DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS that result directly or indirectly or are related in any way to a PsychScan report.
Recipient hereby further agrees to waive any and all present and future claims against PsychScan, Inc., which are in any way related to a PsychScan report, including but not limited to claims, demands, and/or causes of action which allege negligent acts or omissions, or malpractice. In states which do not allow some or all of the above limitations of liability, liability shall be limited to the greatest extent allowed by law.
